What a bail bond actually costs

The premium is capped by statute. Anyone quoting more than this is committing a misdemeanor.

Under O.C.G.A. § 17-6-30, a surety may not charge more than 15% of the face amount of the bond — including principal and all applicable surcharges — with a minimum of $50 per bonded charge. The premium pays for assuming the risk. It is not refundable, win or lose.

A cash bond paid straight to the jail behaves differently — most of it comes back at the end of the case, less non-refundable county fees. Forsyth County accepts cash only for cash bonds: no money orders, business or personal cheques. Call for the exact number on your bond.

Bail bond questions, answered plainly

Georgia caps it. Under O.C.G.A. § 17-6-30 a surety may not charge more than 15% of the face amount of the bond, with a minimum of $50 per bonded charge. Charging above the cap is a misdemeanor. In practice most Georgia bondsmen quote between 12% and 15%. The premium is never refundable.

That belongs to the jail, not the bondsman. Once the bond is in their hands the facility runs its own release process, and how long that takes depends on how many people were booked that shift. Be wary of anyone who promises a specific number of minutes.

Senate Bill 63, effective 1 July 2024, expanded the list in O.C.G.A. § 17-6-12 to more than fifty offenses. If a charge is on that list the person cannot be released on an unsecured judicial release — release must be secured: cash, approved property, or a professional surety. DUI, family violence, battery, theft by deception, obstruction and fleeing are all on it now.

Georgia law sets the outer limits. On a warrantless arrest, O.C.G.A. § 17-4-62 requires the person be brought before a judicial officer within 48 hours. On an arrest with a warrant, § 17-4-26 sets 72 hours. In Forsyth County, Magistrate Court on Tribble Gap Road handles first appearance and bail.

Yes, and a sheriff cannot refuse real property (§ 17-6-15(b)(3)). Forsyth requires the deed and a current paid-in-full tax bill, everyone on the deed present with photo ID, and unencumbered equity of double the bond. A deed search is run and a lien placed until the case is resolved — the county warns it may take several days.

More than most people realise. If the defendant fails to appear, the cosigner is responsible for the full face amount of the bond plus the costs of finding and returning them — not just the premium you paid. Any collateral pledged is at risk. Ask us to walk you through the agreement before you sign it.

The judge forfeits the bond and issues a bench warrant. Under O.C.G.A. § 17-6-71 an execution hearing is set no sooner than 150 days and no later than 180 days after the failure to appear. There are ways back — surrendering within 150 days and paying 5% of the face amount plus costs can satisfy the judgment. The worst move is silence.
